    I was at my local B&M and he says he's getting ready to open up a "smoke easy" since the town a few miles down the road has banned ALL smoking everywhere including condos and townhouses. If you have a detached home you're ok...... for now.

    If you drive a car (most of us do), you're good for 1.5 tons of the following every year: carbon monoxide, nitrogen dioxide, sulfur dioxide, formaldahyde, benzene, particulates, other toxic hydrocarbons. Compare that to the smoke you put into the atmosphere with your cigars. Outdoor smoking bans are based on nothing more than someone not liking what you do. Ironically, many colleges are advocating lowering the drinking age, for practical reasons. That's no doubt because alcohol has become a totally accepted part of college life. I suspect that's because most college administrators drink, but apparently they don't smoke.

    As a commerical property owner, I don't intend to become the smoking police. If the government makes a law, they need to enforce it. Pure and simple.

    As a commerical property owner, I don't intend to become the smoking police. If the government makes a law, they need to enforce it. Pure and simple.
    They would enforce it the same way the owner of an investment property would. They won't patrol or cite somebody if they see them through a window, but if somebody complains about the smoke, it gives them legal grounds to make it stop.

    Trust me, I've been there. Enforcement seems logical like that. But you know you've always got people who will complain, complain, complain, and then complain you're not doing enough about their complaints! That's why I've resisted making my property smoke free. And if (when) a law is passed that says all property outside of private, adults only residence must be smoke free, I suspect there will be a goundswell of protest by property owners, who will take state government to court over the enforcement issue. Eventually it will make it to the Supreme Court where I'm confident they will rule that citizens are not liable for the enforcemement of statutes affecting public conduct. If they rule otherwise, we are officially a totalitarian state.
